Zhao Dagong: The Chinese government will apply Article 106 of the Criminal Law of the PRC to Mr. Zheng Yichun

(July 16, 2005)According to a recent un-identified source, the case of the Chinese dissident Zheng Yichun of Liaoning province, China has a new development. It said that the Chinese government will give-up the previous charge of "subversion the State power or overthrowing the socialist system" of Article 105 of the Criminal Law of the People's Republic of China and replace it with a more severe penalty: Article 106. Article 106 reads: "Whoever commits the crime as prescribed in Article 103, 104 or 105 of this Chapter in collusion with any organ, organization or individual outside the territory of China shall be given a heavier punishment according to the provisions stipulated in these Articles respectively."

This source said, the so-called "collusion with any organ, organization or individual outside the territory of China" of Zheng Yichun is linked to the fact that Zheng Yichun published at "Epoch Times", "ChinaEWeekly", "Boxun" and other internet websites. Because he published articles at those websites, the government concluded that he must have been in collusion with the organizations that run those website. According to this logic, the Chinese government believes a connection must be a collusion.

The famous free-lance writer, poet Zheng Yichun was secretly taken away by Yingkou police, Liaoning province on December 3, 2004 and was put into a room at Jiaohe Hotel under residential surveillance. About 2 weeks later, on December 20, he was transfered to No 1. Detention Center of Panjin city, Liaoning province. His family members were not formally noticed until December 31. The government charged Zheng Yichun of "subversion" and arrested him. It is said that the initial reason Zheng Yichun was taken away was because he exercised Falun Gong. Later, the police searched his residence and sealed his room. Meanwhile, they took away his computer and other equipments. The police collected more than 600 articles that he wrote or published and identified 63 of them as evidence of criminal activities. (boxun.com)

The second paragraph of Article 105 says, "Whoever incites others by spreading rumors or slanders or any other means to subvert the State power or overthrow the socialist system shall be sentenced to fixed-term imprisonment of not more than five years, criminal detention, public surveillance or deprivation of political rights; and the ringleaders and the others who commit major crimes shall be sentenced to fixed-term imprisonment of not less than five years." Normally, the Chinese government charges the dissidents by this item of the Criminal Law if the dissidents publish articles. For this case of Zheng Yichun, however, the Yingkou police either could not find sufficient evidence or could not self-explain its logic. According to the source, the goverment first tried to convince Zheng Yichun that he would be released if he would acknowledge the activities of collusion. Zheng Yichun was cheated and the situation changed dramatically. It is clear that the government will put a heavy charge on him.

The recent political situation in China is horrible right now. The Chinese government has started to suppress the dissidents in a large scale. Internationally, due to frequent terrorist attacts to the west, democratic countries have focus on flighting terrorists. Moreover, this effort requires cooperation with the Chinese government. The international pressure to improve its human rights is subsidized. This makes the Chinese government to violates the human rights without hesitation. Facing this severe situation, we should not be scared away. All the dissidents in China and all the groups in anti-corruption and should stand firmly. The more the dangeous, the firmlier that we stand up. The jailing of Zheng Yichun, Zhang Lin, Li Jianping, Xu Wanping and other heros will inspire all of the dissidents to push for human rights in CHina indomitablly.
